Please read this NOTICE: The TWO Properties for auction ARE UNDER COMMON OWNERSHIP AND are currently enrolled under Act 319, Pennsylvania Farmland and Forest Land Assessment Act of 1974 (Act of December 19, 1974, P.L. 973, No. 319)(72 P.S. 5490.1 – 5490.13). This statute is more commonly referred to as the “Clean and Green” Law which is a program providing for preferential tax assessments. Any future change of use of the property inconsistent with the requirements of the Act may subject Buyer to rollback taxes and interest under the act. 72P.S. 5490.5a.

A sale of the properties to separate bidders will trigger a rollback of taxes under the Act.  In that event, the seller agrees to pay the rollback and applicable interest at the closings.  However, in the event the properties are sold to a single bidder, that bidder will be responsible for the rollback (with interest) if the covenant is breached at any time after title changes hands inasmuch as the Clean and Green Covenant runs with the land (i.e., it lasts in perpetuity, absent a breach).
